Orchid Way Collective exists to recognize artists, not to absorb their work. A submission is an invitation to look carefully. It is not a transfer of ownership.

Your work remains yours

Any artwork you send us, and any photographic, digital, or other visual representation of it, remains the intellectual property of the submitting artist (you, or the rights holder you represent). It is protected by applicable copyright and intellectual property laws.

No license or permission is granted to Orchid Way Collective, or to any third party, merely by the delivery, viewing, sharing, or receipt of your images.

What submission allows

Images and materials submitted through Contact or the Open Call are received solely for private viewing, evaluation, discussion, and consideration by the collective. That limited purpose does not authorize publication, exhibition, sale, licensing, marketing use, social posting, or any other use.

Unless you and Orchid Way Collective agree otherwise in a separate written authorization signed by you (or your authorized representative), neither the collective nor anyone acting for it may copy, reproduce, photograph, scan, publish, display publicly, distribute, transmit, sell, license, sublicense, modify, manipulate, create derivative works from, commercially exploit, upload to third-party platforms, or otherwise use your images or the artwork depicted in them.

No silent transfer of rights

No rights are transferred, assigned, licensed, or granted, whether expressly, implicitly, by implication, by course of dealing, or otherwise, simply because you provided images or because we viewed them.

If a later conversation contemplates exhibition, placement, reproduction, or any public use, that will be set out in a clear written agreement before any such use begins. Silence is not consent.

Unauthorized use

Any unauthorized use, reproduction, publication, distribution, commercial exploitation, or creation of derivative works may constitute copyright infringement and/or violation of other applicable intellectual property rights.
